Kuljic, Vedran
Comments
The video at the start was a good way to introduce the topic, however it had way to much information jammed into each scene and was shown too quickly to keep up. The following presentation slides were full of valuable information but it was hard to decipher what was relevant and what wasn't because there was too much information.

Good video to start. Funny and interesting. presentation had a really good amount of information that was extremely relevant. A very broad but comprehensive look at IP and how it affects us. Great use of examples of IP and how they relate to your project.
Overall Russell's & Steve's Comments
- look out for spelling
- what is the application process of obtaining an IP
- relationship between copyright and patent
- how much differentiation does there need to be?
Information
Intellectual Property
The right to of the creator to protect a product, service or concept (creations of the mind). IP is important because it gives you recognition for the work you do. The Australian is the authority that issues and holds all intellectual property in Australia.
Types of Protection
Copyright - musical, literary and dramatic. There is no need to file for copyright instead it is automatically protected. Copyright lasts for 70 years or ends after death of owner.
Patents - have to apply for it, invention or method is protected, lasts 20 years before patent ends.
Trademark - branded, logos words, phrases, renewal every 10 years
Designs - new and distinctive features, protects the aesthetics not the functionality, lasts 10 years
Confidential Information - ownership over information, aka secret herbs and spices.
How to Register

All Application Processes

- Require you to submit information or proof of what you have done.
- Takes approximately 3 months or longer to attain.
Why Do We Care?
- IP restricts competitive markets
- Gets the owner the respect you deserve
- Gives you the ability to own the design or earn royalties off it.
What can we do if our IP is infringed upon?
- Take them to court
- Enforce your rights
- Get professional advice
What must be proven?
- Physical evidence that you are the owner
- Evidence that someone had tried to copy you
- Prove that they have used it without permission
Youtube IP
Youtube IP - standard - we can use information but cant copy or distribute
Youtube IP Creative commons, issue the right for others to use your designs
How does it relate to our project?
- The design of each bike the MV Augusta and the Honda 750k has its own design patent.
- Does Russell have his own exclusive rights to the sketches he made? Because they are sketches of existing designs.
- When we recreate russells designs who has the rights to the design?
- Is Russell's infringing on IP by creating his photo, because he took it from the internet? How does this affect us. Are we also infringing on IP by working for Russell?
Different Licences
Non Exclusive Licences - can sell to whoever they want as many times as they want.
Exclusive Licences - can only sell to one person, once.
Intellectual Property is a complicated process to understand but with the right guidance from professionals you can licence and manage your own designs so you can get the credit you deserve for your hard work. For our assignment the IP involved in quite complicated as to who owns what and what rights does each party have.
